Petitioners have been made an accused in connection with Special POCSO Case No. 19 of 2024 arising out of Simdega Mufassil P.S. Case No. 06 of 2024, registered for the offence under Section 376-D of the Indian Penal Code and Sections 4/8 of the POCSO Act, 2012, pending in the Court of the learned Sessions Judge-cum-Special Judge, POCSO Act, Simdega. On 17.06.2024 petitioners along with the co-accused persons are alleged to have raped two victims near Banabira forest area. Attention has been drawn towards the statement of the victim recorded during the trial in which they have not identified the petitioners in the dock as the rapists. It was submitted that similarly situated co-accused has been granted bail by co-ordinate bench of this court and the case of the petitioners stands on similar footing.
