To appoint an Arbitrator to adjudicate upon all disputes arising between the petitioner and the Respondent from and out of the Agreement of Understanding dated 04.07.2023 (Annexure-C) as mentioned under Dispute Resolution Clause in the agreement. b. Pass such other order/s as this Court may deem fit, proper, necessary and expedient in circumstances of the case. 2. After arguing for some time, the counsel for respondent submits that a former Judge of this Court could be appointed as sole arbitrator, leaving the contentions open to be decided by the learned arbitrator. In that view of the matter, I pass the following: ORDER i) CMP is allowed. ii) Shri Justice A.N.Venugopala Gowda, former judge of this Court is appointed as a sole Arbitrator to arbitrate the dispute between the - 3 - HC-KAR NC: 2025:KHC:45635 CMP No. 284 of 2025 parties under the aegis of the Arbitration Centre attached to this Court. iii) Registry is directed to forward a copy of this order to the Director, Arbitration and Conciliation Centre for doing the needful. iv) Since the order is passed in the presence of all the counsel, they shall appear before the Director, Arbitration and Conciliation Centre without requirement of any notice on 27.11.2025 at 2.30 p.m. v) All contentions are left open. vi) Original and/or certified copies, if produced are directed to be returned to the respective parties who have produced it/them by following due procedure.
