Mr. Abhijay Negi, Advocate for the petitioners. Mr. N.S. Pundir, Deputy Advocate General for respondent nos.1 and 2. The petitioners are working in Ministerial Cadre of Irrigation Department, State of Uttarakhand. There are 10% posts, which are ear marked for employees for their promotions to Subordinate Junior Engineer. The feeder cadre includes the petitioners’ cadre as well as the Draftsmen. Heard learned counsel for the petitioners and perused the record. It is the case of the petitioners that in the cadre of Draftsmen, relaxation is being granted for their promotions to the post of Subordinate Junior Engineer, but in the cadre of the petitioners, the relaxation is not beneficial because the Draftsmen Cadre employees achieve the bench mark earlier than the petitioners’ cadre employees. He submits that unless the quota is prescribed within the feeder cadre, the petitioners’ cadre which is Revenue and Ministerial Cadre in the Irrigation Department may not get the benefit of promotion as Subordinate Junior Engineer against 10% quota. Learned counsel for the petitioners would submit that the petitioners may be given the liberty to make a representation to the respondent no.2/Engineer-in-Chief raising their grievances. He would submit that the respondent no.2 may be directed to decide their representation within a stipulated time. Learned State Counsel would submit that the respondent no.2/Engineer-in-Chief would take a decision on the representation that may be filed by the petitioners within a period of six weeks. The Court takes on record the statement given by learned State Counsel. The petition is disposed of with the liberty to the petitioners to make a fresh representation within a period of one week to the respondent no.2/Engineer-in-Chief, with further direction to the respondent no.2/Engineer-in-Chief to decide the representation of the petitioners within a period of next six weeks.
