ORAL ORDER

The petitioners have approached this Court seeking a writ of mandamus directing respondent No.4 to consider the representation dated 14.07.2025 (Annexure- F) submitted by petitioner No.1 seeking compensation for an extent of 1 acre 30 guntas in respect of the subject land. 4. Heard learned counsel for the petitioners, learned Additional Government Advocate for respondent No.1 and learned counsel for respondent Nos.2 to 4. 5. land’ for short). Respondent No.2 issued a preliminary notification dated 09.06.2010 under Section 28(1) of the Karnataka Industrial Area Development Act, 1966 (‘KIAD Act’ for short), notifying the entire extent of land for acquisition. Subsequently, a final notification was issued, showing 18 acres 9 guntas of the petition land as acquired by the Karnataka Industrial Areas Development Board (KIADB). 6. Respondent No.4 thereafter issued a joint measurement report, indicating that only 18 acres 9 guntas had been acquired. The petitioners, however, contended that the entire extent of 20 acres 20 guntas had been utilized by the KIADB and submitted representation seeking compensation for the remaining extent. In this regard, respondent No.4, by letter dated 07.05.2025, requested Assistant Director of Land Records (ADLR), Devanahalli Taluk to verify the extent of acquisition and submit a report. Pursuant thereto, ADLR, by communication letter dated 05.07.2025, reported to

HC-KAR NC: 2025:KHC:43688 WP No. 29954 of 2025
respondent No.4 that the entire extent of 20 acres 20 guntas of the petition land had been acquired and developed by KIADB. Based on this report, petitioner No.1 submitted a representation dated 14.07.2025 (Annexure- F) to respondent No.4 seeking compensation for the remaining extent of the acquired land, i.e., 1 acre 30 guntas. 7.
The grievance of the petitioners is that, despite the clear report of the ADLR dated 05.07.2025, confirming that the entire extent of 20 acres 20 guntas has been acquired and developed, compensation has been paid only for 18 acres 9 guntas, leaving out 1 acre 30 guntas. The representation of the petitioners seeking redressal in this regard is still pending before respondent No.4. 8.
Learned counsel for respondent No.4 submits that the petitioners’ representations will be considered in accordance with law within a reasonable time.

9. In view of the above submission, the grievance of the petitioners would stand substantially redressed, if suitable directions are issued to respondent No.4. Accordingly, this Court pass the following:
ORDER i. Writ petition is disposed of. ii. Respondent No.4 is directed to consider the petitioners’ representation dated 14.07.2025 seeking compensation to the extent of 1 acre 30 guntas (Annexure-F), keeping in mind the report of the Assistant Director of Land Records, Devanahalli Taluk dated 05.07.2025, which confirms that the entire extent of petition land i.e., 20 acres 20 guntas has been acquired and developed by KIADB and pass appropriate orders in accordance with law within an outer limit of eight weeks from the date of the receipt of the copy of this order.
