Tiwari, learned advocate, Standing Counsel appears on behalf of State and hands up his instructions with copy to Mr. Rajendra Kumar Singh, learned advocate appearing on behalf of petitioner. He submits with reference to parawise comments made by the Tehsildar, on communication dated 16th September, 2025 that aggregate land was taken in context of cancellation of petitioner's income certificate because petitioner had omitted to indicate his personal holding. On query from Court he submits, on direction made fresh order will be made. 2. Paragraph-1 from order dated 25th August, 2025 is reproduced below. "Mr. Rajendra Kumar Singh, learned advocate appears on behalf of petitioner and submits, under challenge is order dated 17th May, 2025 of respondent no.4 cancelling the income certificate based on purported report of the Lekhpal. There has been addition of family members' land to say, petitioner is entitled to aggregate land." 3. In view of instructions issued by the Lekhpal, we think it fit to set aside impugned order dated 17th May, 2025 and restore consideration of petitioner's income certificate for fresh order being made, either confirming issuance of it or cancelling it for reasons given. Adverse decision, if taken against petitioner will remain stayed till two weeks after it is informed to him. 4. The writ petition is disposed of.
