CRL MP No. 16388 of 2024 Prayer: This petition is filed under Section 483(3) of Bharatiya Nagarik Suraksha Samhita (BNSS), 2023, to pass an order cancelling the anticipatory bail granted to the 2nd respondent/accused No.2 under the order dated 20.03.2024 passed in Crl.O.P.No.22982 of 2023. https://www.mhc.tn.gov.in/judis CRL MP No. 13502 of 2025 __________ Page3 of 6 In all the petitions For Petitioner(s): For R2 M.Ramamoorthi Mr.G.Mohammed Aseef For R1: Mr.N.Palanivel Government Advocate (Criminal Side) Common Order These petitions have been filed seeking the cancellation of the bail granted to the second respondent by this Court in Crl.O.P.Nos.23191, 23024, and 22982 of 2023, vide order dated 20.03.2024. 2.The learned counsel for the petitioner submitted that the applications for cancellation of bail were filed because the second respondent/accused Nos. 1, 2 & 4 were involved in tampering with witnesses. When this Court put a pertinent question, the learned counsel for the petitioner tabulated six instances of witness tampering. However, no materials were produced by him to substantiate these instances. 3.The first point raised is that the second respondent is blocking other accused persons from settling their dues, which cannot be construed as a violation of bail conditions. The second instance alleged is that they are not cooperating with the investigation. The other instances referred to are in respect of the payment of the amount to the defacto complainant. https://www.mhc.tn.gov.in/judis CRL MP No. 13502 of 2025 __________ Page4 of 6 4.The learned Government Advocate (Crl. side) fairly submitted that the second respondent/accused Nos. 1, 2 & 4 are cooperating with the investigation and have not been blocking any of the witnesses. 5.While considering an application for the cancellation of bail, this Court must only consider whether there is any violation of the bail conditions. Although the learned counsel for the petitioner mentioned that the accused were not cooperating with the investigation, the learned Government Advocate (Crl. side) fairly submitted that they have been cooperating. Regarding the tampering of witnesses, although certain allegations are made in the petitions, there is no supporting material except the ipse dixit of the petitioner. 6.In such view of the circumstances, and considering that a person's liberty is protected under Article 21 of the Constitution of India, a strong reason is required to cancel bail.
