Also heard Mr. N. Upadhyay, learned Standing Counsel, Irrigation Department, Assam appearing for the respondent Nos.1, 3 and 4. None has appeared for the remaining respondents. The writ petitioner herein, who was initially appointed as a Muster Roll Worker and was subsequently regularised in service, has approached this Court by filing the writ petition seeking a writ of mandamus directing the authorities to pay his arrear salary and other retirement benefits including the regular pension. Mr. Upadhyay submits that the grievance of the petitioner has long been redressed by the authorities and therefore, nothing further survives for adjudication in this writ petition. Mr. Hussain, learned counsel for the petitioner, on the other hand, submits that he has lost contact with his client and therefore, he is unable to confirm the submission of the departmental counsel. Be that as it may, taking note of the submission made by Mr. Upadhyay, this writ petition stands disposed as infructuous by granting liberty to the petitioner to Page No.# 3/3 revive the same, if the submission of the learned departmental counsel turns out to be factually incorrect.
