ORDER This Civil Revision Petition has been filed, challenging the impugned
order dated 19.06.2025 passed by the Court of Sessions, Mahila Court, Chengalpattu, in I.A. No. 3 of 2025 in O.S. No. 626 of 2023. https://www.mhc.tn.gov.in/judis
CRP No. 4030 of 2025
2. The petitioner is the defendant in the suit and the respondent is the plaintiff. The suit has been filed for ejectment, seeking to vacate the petitioner/defendant from the schedule premises. During the course of trial, documents were marked as exhibits on the side of the respondent/plaintiff.
3. According to the petitioner, who is the defendant, Exhibit A1 (Lease Agreement dated 14.01.2014) and Exhibit A2 (Rental Agreement dated 14.10.2017) have been insufficiently stamped and unregistered and therefore they ought not to have been marked as exhibits by the trial Court.
4. In the application filed by the petitioner in I.A. No. 3 of 2025 under Section 33 of the Indian Stamp Act, 1899, read with Section 30 and Order XIII Rule 8 of CPC, seeking to impound the documents, namely Exhibits A1 and A2, referred to supra, the trial Court has dismissed the said application through the impugned order dated 19.06.2025.
5. The learned counsel for the petitioner submits that the trial Court has erroneously marked the exhibits A1 and A2, as exhibits on the side of the respondent / plaintiff, though the said documents are unregistered and https://www.mhc.tn.gov.in/judis
CRP No. 4030 of 2025 insufficiently stamped are inadmissible evidence.
6. According to the learned counsel for the petitioner, there is no judicial detriment on the part of the trial Court while marking the Exhibits A1 and A2. This Court suggested to the learned counsel for the petitioner as to whether the petitioner will be satisfied if the trial Court, uninfluenced by any of the observations made by the trial Court in the impugned order, decides the main suit by permitting the petitioner to raise the very same objections that have been raised in I.A. No. 3 of 2025 in O.S. No. 626 of 2023 at the time of main
arguments in the suit. The learned counsel for the petitioner fairly accepted the suggestion made by this Court.
7. This Court gave the aforesaid suggestion to the learned counsel for the petitioner in view of the fact that the Civil Revision Petition is pending from 2025 onwards. The learned counsel for the respondent/plaintiff has also not raised any serious objection if such a direction is issued by this Court.
8. For the foregoing reasons, the Civil Revision Petition is disposed of by vacating the interim stay granted by this Court in this Civil Revision Petition and by directing the trial Court to dispose of the suit, O.S. No. 626 of 2023, https://www.mhc.tn.gov.in/judis
CRP No. 4030 of 2025 uninfluenced by any of the observations made by the trial Court in the impugned order dated 19.06.2025 passed in I.A. No. 3 of 2025 in O.S. No. 626 of 2023 and by permitting the petitioner / defendant to raise all objections with regard to the marking of Exhibits A1 and A2 on the side of the respondent/plaintiff, which, according to the petitioner, are inadmissible evidence since the said documents are allegedly insufficiently stamped and unregistered documents.
9. This Court is not expressing any opinion on the merits of the petitioner's contentions before this Court as it is open for the trial Court to consider the objections of the petitioner on merits and in accordance with law after hearing the submissions of the learned counsel for the respondent in the main suit.
10. The trial Court, namely, the Court of Sessions, Mahila Court, Chengalpattu, is directed to dispose of the suit, O.S. No. 626 of 2023, within a period of four months from the date of receipt of a copy of this order. No Costs. Consequently, connected miscellaneous petition is closed. 21-07-2026 https://www.mhc.tn.gov.in/judis
