(Oral) Applicant Suresh Pal is in judicial custody in FIR No. 141 of 2021 dated 03.07.2021, under Sections 302, 323, 504, 506, 34 IPC, at Police Station Khanpur, District Haridwar. He has sought his release on bail. 2. This is fourth bail application of the applicant. His first, second and third bail applications have already been rejected by this Court on 17.10.2022, 16.02.2023 and 24.07.2023, respectively. 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant submits that the applicant is in custody for last more than four years and for almost last two years, no witness has been examined; the applicant is in custody since 08.07.2021; out of 23 prosecution witnesses, only 14 witnesses have been examined; the last witness was examined on 27.04.2023. 2 5. These factual aspects are not disputed by the learned State Counsel. 6. Having considered the period of incarceration and other attending factors, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant Suresh Pal be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
