1. By the present writ petition, the petitioner who is one of the villagers of village Chandkhuri, is seeking a direction towards the respondent authorities for taking action on the representation/ complaint made by the petitioner regarding the illegal mining of soft stone (Moorum).

Learned counsel appearing for the petitioner submits that the respondent No.6 is doing illegal mining of soft stone (Moorum) from the nearby ponds and canals situated in village Chandkhuri and the petitioner alongwith the villagers are being the users of the said ponds, are facing grave hardship to access the ponds and canals which are situated in the said village. He further submits that the petitioner has raised his grievance before various authorities including the respondent No.2/Collector, Durg by submitting representations dated 21/05/2024 and 21/06/2024 (Annexure P/2 & P/5 respectively) however, the Collector has not taken any steps towards the grievance raised by the petitioner.

Learned counsel appearing for the State submits that if the representation/s submitted by the petitioner is still pending before the Collector, the Collector shall look into the matter and will take necessary steps regarding the redressal of the grievance raised by the petitioner in accordance with law within the stipulated time.

4. I have heard learned counsel for the parties, perused the documents and the representations made by the petitioner before the Collector.

As the petitioner raised a specific grievance against the illegal mining of soft stone (Moorum) by the respondent No.6 and in response to the same, the Collector has not taken any decision or steps, the respondent No.2/ Collector, Durg is directed to look into the matter and after proper verification and examination, necessary steps be taken against the said illegal mining, by providing sufficient opportunity of hearing to all the affected parties, in accordance with law, within a period of 20 days from the date of receipt of a copy of this order. The petitioner is at liberty to apprise the Collector about the order of this Court.
6. With the aforesaid direction, this writ petition is disposed of.
