ORDER 08.09.2025
01. The Court of Civil Judge, Senior Division (Sub Judge), Srinagar, by virtue of order dated 23.10.2024, has primarily come to dispose of a temporary injunction application filed by six plaintiffs, three of whom are the petitioners herein, whereas three proforma respondents are other three co-plaintiffs thereby rendering two more applications self frustrated and dismissed for want of merit.
02. The order dated 23.10.2024, being an adjudication under Order 39 Rules 1 and 2 Code of Civil 08 Regular
Procedure, 1908, is amenable to an appeal under
Order 43 Rule 1(r) of the Code of Civil Procedure, 1908 as such the present petition filed by the three petitioners invoking the supervisory jurisdiction of this Court under Article 227 of the Constitution of India is misconceived and hence, the same is held to be not maintainable leaving the petitioners to work out their legal appropriate remedy if any still available with respect to the
Order dated 23.10.2024 passed by the Court of Civil Judge, Senior Division (Sub Judge) Srinagar.
