PERMISSION OF THE TRAIL COURT IMPOSED UPON HIM WHILE GRANTING BAIL IN CRL.P.No.8858/2019 BY ITS ORDER DTD 20.01.2020 BY HONBLE HIGH COURT IN CR.No.187/2019 FOR THE OFFENCES PUNISHABLE UNDER SECTION 498A AND 306 OF THE IPC.

ORAL ORDER
This petition is filed by the petitioner -accused No.1 under Section 439 (1)(b) of Cr.P.C praying to relax condition No.(v) i.e., “He shall not leave the territorial limits of the Trial Court without prior permission of the Trial Court” imposed in the order dated 20.01.2020 passed in Criminal Petition No.8858/2019 by this Court in Crime No.187/2019 registered for offences punishable Under Sections 498A and 306 of IPC.
2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State.

Learned counsel for the petitioner would contend that the said condition is causing hindrance in

travel of this petitioner to different places. As he is working as a software engineer in a private sector and he has to move from one place to another place. He submits that the petitioner has not violated any of the conditions imposed by this Court. With this, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader for the respondent –State would contend that the petitioner has filed discharge application and is dragging the matter and it has caused delay in disposal of the case. With this, he prayed for dismissal of the petition. 5. Having heard learned counsels, this Court has perused the materials placed on record. 6. The petitioner has been granted bail in respect of Crime No.187/2019 of Kothanur Police Station registered for offences punishable under Section 498A and 306 of IPC by this Court by order dated 20.01.2020 passed in Criminal Petition No.8858/2019. The said bail is granted subject to following conditions;

i) Petitioner/accused No.1 is ordered to be enlarged on bail on furnishing a bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. ii) He shall appear before the court as and when required. iii) He shall not threaten or allure the prosecution witnesses in whatsoever manner. iv) He shall not get involved in similar offences. v) He shall not leave the territorial limits of the Trial Court without prior permission of the Trial Court.”
Pursuant to said conditions, the petitioner has been released on bail. There is no allegation of petitioner violating any of the conditions. The petitioner earlier had approached this Court seeking permission to go to United States for attending meetings. The petitioner is working as an engineer in a private concern and as submitted he has to travel from one place to another including the other

countries. The petitioner is resident of Bihar and he has to go to his native place occasionally. If the condition sought to be relaxed is not relaxed, petitioner will be put to hardship.
Considering the above aspects, the petitioner has made out case for relaxing the condition. 7. In the result, the following
ORDER i) The petition is allowed. ii) The condition No.(v) imposed in the order dated 20/01/2020 passed in Crl.P.No.8858/2019 by this Court is relaxed
