2. The learned counsel for the petitioner submitted that although this Court, vide order dated 03.06.2024 in W.P. No. 11806 of 2024, directed the respondent therein to consider the petitioner’s representation for issuance of a subdivision patta in the name of the petitioner, the respondent has passed the impugned order stating that pending the civil suit, the concerned authorities should not pass any orders. 3. The learned Government Counsel appearing for the respondent submitted that the petitioner has filed a suit for declaration, which is currently pending. He contended that during the pendency of a civil suit, the concerned authorities cannot mutate revenue records, and therefore, it is not possible for the respondent to subdivide the property and issue a separate patta unless and until the suit is decided. 4. Heard both sides and perused the materials available on record. 5. Considering the submissions made by both parties, this Court finds force in the submission of the learned Government Counsel. The petitioner himself has filed a suit for declaration. When a civil suit is pending, revenue authorities cannot mutate revenue records. Furthermore, if the petitioner is aggrieved by the rejection order, the alternative remedy available to the petitioner is to file an appeal before the Revenue Divisional Officer.

WP No. 15904 of 2025 __________ Page3 of 4 liberty is granted to the petitioner to file an appeal before the RDO under Section 12 of the Tamil Nadu Patta Pass Book Act, 1983, within a period of 30 days as mandated under its provisions. 6. In view of the above, this Writ Petition is dismissed. No costs. Consequently, W.M.P.
