ORAL ORDER (PER: HON'BLE MR. JUSTICE D K SINGH)
The petitioner applied for National Eligibility cum Entrance Test UG 2024 (NEET UG 2024). The result of the examination would show that the petitioner secured All India Rank of 22874. The petitioner had also sought the benefit of him being an OBC candidate. 2. The petitioner was allotted a seat in Chitradurga Medical College and Research Institute, a Government Medical College, after Counselling and he deposited the fee in the said college on 18.10.2024. 3. The college, by some mistake, had admitted one more student for the same academic session i.e., 2024-25 in excess of the sanctioned seats for admission to the first year MBBS course. The college authorities, when reconciled the admissions and the seats sanctioned for taking admission in the said college for the first year MBBS course, found that one candidate

has been admitted in excess of the sanctioned seats and they addressed a letter to the Secretary, Medical Counselling Committee, New Delhi. The said letter was forwarded to the National Medical Commission i.e., the 4th respondent who is the competent authority for sanctioning the seats in a medical college for Undergraduate and Post-Graduate courses as well as for Super-specialty courses. In response to the letter written by the college, the National Medical Commission, vide communication dated 03.07.2025, has accepted their request for creation of one supernumerary seat in the said college for the academic session 2024-25 in favour of the petitioner, and it has been stated that for the next academic session in 2025-26, the sanctioned seats would be reduced from 150 to 149. 4. In the light of the letter dated 03.07.2025 written by the National Medical Commission to the college which is part of the statement of objections filed on behalf of respondent No.4, the petitioner's admission has been regularized by creating one supernumerary seat in the said college for the academic year 2024-25 with a rider that for the next academic session 2025- 26, one seat shall be reduced and the college shall be entitled

to take admission only up to 149 candidates. Therefore, nothing survives in this writ petition. Accordingly, the writ petition is disposed of.
