ORAL ORDER Petitioner is seeking to enlarge him on bail in Crime No.39/2025 of Akkur Police Station, Channapatna Taluk. 2. FIR is registered against 5 to 6 unknown persons for the offence punishable under Section 310(2) of BNS, 2023, on a complaint lodged by one Kumara N.H. On completion of investigation, charge sheet has been filed against 11 accused for the offence punishable under Section 311, 61 (2) of BNS, 2023. 3. It is the case of prosecution that the accused planned to rob the persons playing cards in the land of CW.2 in Nelamakanahalli, Veerupakshipura Hobli, Channapatna Taluk and to execute the plan, travelled in different vehicles on 23.03.2025 at about 11.00 p.m., and threatened CW.1 to CW.19 who were present in the land of CW.2, showing deadly weapons, assaulted and robbed a sum of `20,000/- from CW.11, one keypad mobile phone and a cash of `3,000/- from CW.17. - 3 -

The learned HCGP has contended that there is one more case registered against the petitioner in Crime No.131/2022 at Gubbi Police Station, Thumakuru for the offence punishable under Section 302 IPC. He therefore contended that if the petitioner is released on bail, he may commit similar offence/s and sought to dismiss the petition. 5. FIR is registered against 5 to 6 unknown persons. While filing charge sheet, petitioner is arraigned as accused No.9. He was arrested on 08.04.2025. From him, a cash of `3,000/- has been allegedly recovered. 6. Learned counsel for the petitioner has contended that there is no test identification parade conducted in this case and petitioner has been falsely implicated. He submits that other accused are enlarged on bail and the petitioner has been granted bail in the case registered against him at Gubbi Police Station. - 4 -

7. The prosecution has to establish its case against the petitioner in a full-fledged trial. Similarly placed accused are enlarged on bail. As per FIR, 5 to 6 persons committed the offence, however, charge sheet is filed against 11 accused, wherein petitioner is arraigned as accused No.9. In the facts and circumstances, by imposing conditions, petitioner can be released on bail.
Accordingly, the following:
ORDER Petition is allowed. Petitioner/accused No.9 in Crime No.39/2025 of Akkur Police Station, Channapatna Taluk shall be enlarged on bail, subject to following conditions:
1. He shall execute a personal bond for a sum of `50,000/- (Rupees fifty thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.

2. He shall furnish proof of his residential address/contact number and shall inform the Court, if there is change in the address/contact number.
3. He shall not leave the jurisdiction of the trial Court without prior permission of the learned Sessions Judge.
4. He shall not tamper with the prosecution witnesses either directly or indirectly.
5. He shall not indulge himself in criminal activities.
6. He shall appear before the trial Court on all dates of hearing without fail. Violation of condition/s shall result in cancellation of bail. Sd/- (MOHAMMAD NAWAZ) JUDGE BS List No.: 1 Sl No.: 36
