The present writ petition has been filed challenging the impugned First Information Report dated 09.08.2025 lodged as Case Crime No. 334 of 2025, under Section 108 The Bharatiya Nyaya Sanhita, 2023, Police Station Thakurdwara, District Moradabad. It has been argued by the counsel for the petitioner that the First Information Report has been lodged only to harass and extract money from the petitioners and there is no evidence to support the general allegations made in the FIR. It has been further argued that for the aforesaid reason the first information report dated 09.08.2025 is liable to be quashed. The AGA has opposed the petition. In the circumstances of the case and after considering the rival submissions of the counsel for the parties, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance to the First Information Report dated 09.08.2025 lodged at Case Crime No. 334 of 2025, under Section 108 The Bharatiya Nyaya Sanhita, 2023, Police Station Thakurdwara, District Moradabad till submission of the police report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
