For Petitioner(s): Mr.E.C.Ramesh For Respondent(s): Mr.R.Ganesh Kumar Counsel for Government for R1 & R2 Mr.N.S.Suganthan for R3 & R4 ORDER This Petition has been filed seeking direction to the 1 and 2 respondent to initiate of Interest of Depositors (in Financial Establishments) Act 1997 in respect of the property described in Patta No.935, Old Survey No.64/5B, Re- Survey No.64/5B1, having extend of 1.75 Acres land, situated at Palakkarai Village, Perundurai Taluk, Erode District based on Petitioners representation dated 09.10.2025. 2. Petitioner is one of the accused in Crime No.15 of 2017 for the offence under Sections 420 of IPC and Section 4 of Prize Chit & Money CIR Schemes (Banning ) Act, 1978. After completion of Investigation, final report has been filed and the same was taken cognizance in C.C.No.06 of 2019. Now, the petitioner submitted representation seeking attachments of property, which was already sold out in favour of the 3rd respondent herein. No. 1274 of 2025 __________ Page3 of 4 respondent. 3.In view of the above, the said property cannot be attached, as this Court had already permitted the sale to the 3rd respondent. Apart from that, there is no evidence to show that the petitioner purchased the said property using the proceeds of the crime. 4.
