Bhattacharjee, G.A. 22.05.2025 Order This present application has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “A. Admit the instant Writ Petition B. ISSUE RULE, NISI C. Issue Notice to the Respondents. D. A Rule be issued, calling upon all the Respondents and each one of them, to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued, directing the respondents and each of them, to preserve the rights guaranteed under Article 14, 21 and 300 A of the Constitution of India. E. A Rule be issued, calling upon all the Respondents and each one of them, to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued, directing the respondents and each of them, to pay the Petitioner the amount of Rs. 10,86,800/-(ten lakh eighty six thousand eight hundred) which is the arrear payment of the family pension (Rs.28,600/-) from June, 2016 to July, 2019 (38 months) along with group insurance, leave salary, the rest of the payment of commutation and gratuity. F. A Rule be issued out of and under seal of this Hon'ble Court commanding the Respondents and each one of them to show cause why a writ of or in the nature of Mandamus should not be issued directing the respondents and each of them to quantify forthwith the amount in respect of (1) fixation of pay, (2) remaining pension, (3) commutation of pension, (4) gratuity, (5) group insurance, (6) leave salary, etc., which amounts to Rs. 14,14,312/-(Fourteen lakhs fourteen thousand three hundred and twelve) approx. strictly in accordance with law as narrated in this petition and pay the same to the petitioner without any further delay. G. A Rule be issued out of and under seal of this Hon'ble Court commanding the Respondents and each one of them to show cause why a writ of or in the nature of Certiorari should not be issued directing all the Respondents and each one of them to produce all relevant documents and/or records relating to the subject matter of this case before this Court, so conscionable justice may be administered after perusing the same. H. To make the Rule absolute if no cause or sufficient cause is shown or made. I. Cost and incidentals of this application be borne by the Respondents. J. Any other or further order or orders, direction or directions be passed which this Hon'ble Court may seem fit and proper. 2. Heard Mr. D. Chakraborty, learned counsel appearing for the petitioner as well as learned G.A., appearing for the State-respondents. 3. It is seen from the record that the petitioner has submitted representations dated 25.07.2022 and 13.01.2025, addressed to the Principal Chief Conservator of Forests and Head of the Forest Force (PCCF & HoFF), ventilating her grievance. The petitioner also received a letter dated 30.01.2025, sent to the District Forest Officer, Khowai District, from the Office of the Principal Chief Conservator of Forests, Government of Tripura, addressing the representations submitted by the petitioner regarding non- receipt of pensionary benefits. However, till date, the grievance of the petitioner remains unattended. Page 3 of 3 4. In view of the same, without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to the concerned respondents to consider the case of the petitioner in light of the communication dated 30.01.2025, within a period of 2(two) months from the date of receipt of copy of this Order, in accordance with law. 5. With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
