ORAL ORDER
The petitioner is before this Court on the score that application in I.A. II in O.S.No. 549 of 2025 was not considered by grant of temporary injunction as was sought for but only issued notice on 16/4/2025 to the defendant-respondent herein.
2. Heard the learned counsel for the petitioner and the
learned counsel for the respondent.
3. The respondent is said to be now represented before the concerned Court and this Court going to the fact that the petitioner should be protected. In the interregnum, the coordinate bench had granted interim order of stay and
directed the parties to maintain status quo in respect of the schedule property in terms of its order dated 29.4.2025.
2. In the light of the said order subsisting, I deem it appropriate to continue the same for a period of 4 weeks from

today, and direct the concerned Court to consider the application so filed along with the suit under Order 39 Rule 1 & 2 in accordance with law, and endeavor to pass necessary orders on the said application before the expiry of the 4 weeks that is now granted.
3. The learned counsel for the respondent submits that the next date before the concerned Court is on 3.9.2025.
4. The parties are at liberty to file an application seeking advancement of the hearing of the application under
Order 39 Rule 1 & 2 of CPC, at which point in time, the concerned court will bear in mind the observations made in the course of the order and pass necessary orders as indicated herein. The petition is disposed off. Ordered accordingly.
