The petitioner is before this Court seeking for the following reliefs; a. Appoint an Arbitrator to adjudicate the dispute between the parties under Section 11(6) of Arbitration And Conciliation Act, 1996, Arbitration Clause 11 at Annexure-C dated 06.03.2023. b. Grant such other reliefs as this Hon’ble Court may deems fit to grant, in the circumstances of the case, including an order to costs, in the interest of justice and equity. 2. This Court having issued notice to the respondent, notice having been served, respondent has not entered appearance. 3. A perusal of the offer of employment indicates that the said employment offer is governed by an arbitration clause. The dispute as raised by the petitioner in the legal notice is only in regard to damages claimed and not performance of any obligation on part of the respondent. In that view of the matter, the said dispute being arbitrable, notice - 3 - HC-KAR NC: 2025:KHC:45996 CMP No. 363 of 2025 having been issued in a proper manner complying with Section 21 of the Arbitration and Conciliation Act, I pass the following: ORDER i. CMP is allowed. ii. Smt.Rahat Afshan.H.N, a Senior Civil Judge (retired) of the District Judiciary, State of Karnataka is appointed as a sole arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court. iii. Registry is directed to forward a copy of this order to the Director, Arbitration & Conciliation Centre for doing the needful. iv. Since the order is passed in the presence of both the counsels, the counsels are directed to appear before the Director, Arbitration & Conciliation Centre without requirement of any notice at 2.30 p.m. on 19.11.2025 v.
