HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL APPEAL No. - 7492 of 2025 Court No. - 86 HON'BLE SHEKHAR KUMAR YADAV, J.
1. List of fresh cases has been revised. None has appeared on behalf of appellant. However, Mr. Pankaj Kumar Sharma, learned counsel for the respondent no.2 is present.
2. The present criminal appeal under Section 14-A(1) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been preferred for setting aside the order dated 10.07.2025 passed by Additional Session Judge/Special Judge (SC/ST Act) Rampur in Criminal Misc. Application No.29 of 2025 (Ram Prasad vs. Jagdish and others) at Police Station Memri, District Rampur whereby the court below rejected the application under section 173 (4) BNSS filed by the appellant.
3. At the outset, Mr. Pankaj Kumar Sharma, learned counsel for the respondent no.2 has raised a preliminary objection regarding maintainability and has stated that the court below has rightly rejected the application filed by the appellant under Section 173 (4) BNSS on the ground of non jurisdiction of hearing of corruption matters. Appellant has also not clarified the legal position regarding jurisdiction to hear the case before the court below.
4. I have gone through the impugned order and find that the impugned order passed by the court below is well in conformity in law and does not suffer from error of illegality, irregularity and warrant any interference by this Court.
5. The appeal is without merit and is hereby dismissed.
