This is a defendant's petition. It is contended by learned counsel for the petitioner that in the suit filed by the plaintiff-respondent, an application for grant of temporary injunction was moved in which the objection was filed by the petitioner-defendant which till date has not been decided. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Civil Judge (Junior Division)/FTC, Mirzapur to proceed with the matter and in case the temporary injunction application has not decided till date, the same may be considered by the Court concerned after considering the objections filed by the defendant-petitioner within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
