For Petitioner(s): No appearance For Respondent(s): M/s.G.Djearany Government Advocate (Puducherry) ORDER This Writ Petition has been filed to quash the entire records which culminated in issuing the impugned Memorandum No.3147/SDM(N)/Court/1488 Puducherry dated 29.05.2025 of the first respondent and consequently direct the first respondent to implement his own order dated 06.04.2023 and the consequential notice dated 25.04.2023, No.2023/TOP/A/Eviction/2023. 2. A perusal of the records reveals that the first respondent passed an order dated 06.04.2023 in M.C. No. 149 of 2022 under Section 145 of the Cr.P.C. Thereby, the Tahsildar-cum-Executive Magistrate, Taluk Office, Puducherry was directed to attach the house mentioned in the schedule of property by taking and keeping possession thereof, and to hold the same under attachment until a decree or order of a competent Court determining the rights of the parties or their claim to possession is obtained. No. 1242 of 2025 __________ Page3 of 4 appointed as the receiver of the said house mentioned in the schedule of property under Section 146(2) of the Cr.P.C., and the third respondent was directed to provide assistance for the execution of the order. Accordingly, the Tahsildar took action, against which the 4th respondent filed W.P. No. 14566 of 2023 before this Court, which was subsequently dismissed as withdrawn. That apart, since the dispute regarding the subject property was disposed of on 06.04.2023 in M.C. No. 149 of 2022, the representation submitted by the petitioner after a period of two years cannot be considered and was rightly rejected. Hence, this Court finds no infirmity or illegality in the impugned order. 3. Accordingly, this Writ Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
