CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Santosh Kr. Tiwari, Advocate For the State
: Mrs. Lily Sahay, Addl. P.P. ------
Order No.02 Dated- 23.04.2025
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Namkum P.S. Case No.184 of 2022 (N), corresponding to N.D.P.S. Case No. 18 of 2024 registered for the offences punishable under sections 15(c)/18(b)/25/29 of the N.D.P.S. Act.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is involved in possession and transportation of Poppy Straw in commercial quantity and 666 Kg. of Doda Powder was recovered from a vehicle allegedly being transported by the petitioner. It is further submitted that the allegations against the petitioner are all false and the petitioner has no concern with the vehicle in question. It is then submitted that the petitioner has been implicated in this case because of business rivalry. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that after investigation of the case, police found the allegation against the petitioner to be true and submitted charge sheet against the petitioner and in view of the seizure of Doda Powder in commercial quantity; the rigors of
Section 37 of the N.D.P.S. Act is attracted in this case. It is next submitted that in the absence of any material to show that there is reasonable grounds to believe that the petitioner is not guilty of the offence alleged and he is not likely to commit any offence while on bail, the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner and in the absence of any material to show that there is reasonable grounds to believe that the petitioner is not guilty of the offence alleged and he is not likely to commit any offence while on bail, this Court is of the considered view that this is not a fit case where the above-named petitioner be admitted to bail.
Accordingly, the prayer for bail of the above-named petitioner is rejected.
