The limited grievance of the petitioner by way of this petition filed under section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 is that the petitioner filed a complaint case under Section 200 of the CrPC against the Respondent for the offence punishable under Section 138 of the Negotiable Instrument Act, 1881. It has been alleged by the petitioner that she handed over her gold jewellery to Respondent as loan(amount of which was calculated to be Rs. 12 lakh) with a promise from the respondent that he would return the said jewellery within two months. However, when respondent showed his inability to return the jewellery and after much effort owing to the said liability, the respondent handed over three cheque of Rs. 4 lakhs each to the petitioner. But the cheque got dishonored and a notice in this regard was sent to the
2 respondent and due to non-payment of said amount, the instant complaint was filed.

Learned counsel for the petitioner prays this Court to allow this criminal miscellaneous petition and may direct the learned Trial Court to decide the case of the petitioner within a time frame in the interest of justice.

Considering the limited grievance of the petitioner and also looking to the facts and circumstances, it is directed to make all endeavors to conclude the proceedings pending before the learned Judicial Magistrate, First Class, Raigarh, in complaint case no. 03 of 2022 filed under Section 138 of the Negotiable Instrument Act, 1881 as early as possible if no legal impediment.
