ORAL ORDER
After arguing matter for some time and being prompted to settle matter mutually and to put a quietus to issue, learned counsel for petitioners, on instructions from parties who are present before Court today and learned counsel for respondents jointly submit that matter is settled between parties, respondent no.1 has agreed to receive sum of Rs.3 Lakhs towards full and final settlement of his claim against petitioners insofar as award dated 04.07.2023 passed by XXII Addl. Court of Small Causes and Addl. Chief Metropolitan Magistrate and MACT, Bengaluru, in MVC no.1145/2021 at Annexure-B.
2. A Joint Memo is filed to said effect, which reads as under:
"1. The Petitioners submit that they have agreed to pay a sum of Rs.3,00,000/- (rupees three Lakhs ) towards professional charges to the respondent No-1 after receipt of the compensation before the MVAT, Bengaluru.
2. The respondent No-1 declare that she has no objection for the petitioners to engage any other advocate for withdrawal of the compensation awarded before the tribunal (SCCH No.24) in MVC No.1145/2021.
3. The respondent No-1 further under take to withdraw the W.P.No.11712/2024 filed against the Petitioner No-1 which is pending before this Hon'ble Court.
4. Both the parties agreed to dispose of the above petition on the above terms in the interest of justice."

3. Petitioners, who are present in Court undertake to strictly abide by terms of settlement/joint memo. Likewise,
learned counsel for respondent no.1 submits that WP no.11712/2024 stated to have been filed with regard to same subject matter shall be got dismissed in view of settlement herein.
4. Joint Memo and undertaking of respective parties taken on record. Writ petition is disposed of in terms of joint memo by clarifying that in view of above settlement, in case petitioners intend to engage any other counsel for withdrawal of award amount in MVC no.1145/2021, Tribunal would require to permit same and respondent no.1 would not oppose same. Since it is submitted that award amount deposited by respondent no.2-insurer is laying idle, Tribunal is directed to release amount as per award, forthwith.
