HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 7052 of 2025 Court No. - 69 HON'BLE VIVEK VARMA, J. 1. Heard Sri Raghuvansh Misra, counsel for the applicant; Sri Udayan Nandan and Sri Anuj Srivastava, counsel for the informant and Sri Neeraj Kumar Sharma, learned A.G.A. for the State. Perused the material available on record. 2. This application under Section 482 B.N.S.S. has been filed seeking anticipatory bail in Case Crime No. 296 of 2025, under Sections 318(4), 319(2), 336(3), 338, 340(2), 352 of B.N.S., Police Station -Meja, District - Prayagraj. 3. Counsel for the applicant submits that the applicant is a lady, aged about 61 years and has been falsely implicated in the present case. The applicant has not prepared any false documents. The applicant has no criminal antecedents. Investigation is pending. The applicant has apprehension of her arrest in the above mentioned case and in case she is granted anticipatory bail, she will not misuse the said liberty. 4. On the other hand, learned A.G.A. for the State and counsel for the informant have opposed the prayer for anticipatory bail. It is submitted that that the applicant in collusion with three named accused and certain unknown persons, forged the signature of Yagya Narayan Singh, the President of Committee of Management, and fabricated documents. Using such forged documents, approval was obtained from District Inspector of Schools (Second), Prayagraj, for appointment of Ankita Yadav as Manager of Shakuntala Devi Yadav Kanya Inter College, Ramnagar, Meja, Prayagraj Versus Counsel for Applicant(s) : Raghuvansh Misra, Yagyadhar Tripathi Counsel for Opposite Party(s) : Anuj Srivastava, G.A., Shubham, Udayan Nandan Shashibala Yadav .....Applicant(s) State of U.P. and Another .....Opposite Party(s) for five years from 31.3.2020. The President of Committee of Management, in his statement under Section 180 B.N.S.S. has specifically stated that the applicant forged his signature and fabricated documents. 5. After having heard learned counsel for the parties and having perused the record, this Court prima facie finds that specific allegation of forging the signature of the President of Committee of Management and fabricating documents has been levelled against the applicant. The offence is grave. There is likelihood that the applicant has committed the offence. 6. In my opinion, this is not an appropriate case for grant of anticipatory bail. Hence, this application is hereby rejected, leaving it open to the applicant to apply for regular bail before the concerned court, which application when filed, may be considered on its own merits, without being prejudiced by any observation made in this order.
