THIS PETITION COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
The parties and their respective counsel are present. 2. This revision petition is directed against the judgment passed in Crl.A.No.60/2023 dated 15.11.2023 by the I Additional District & Sessions Judge, Mysuru, whereby the learned Sessions Judge has confirmed the judgment of conviction and order of sentence dated 11.01.2022 passed by the V Additional Civil Judge & JMFC, Mysuru, in CC.No.411/2016. Wherein the revision petitioner
3 was convicted for the offence punishable under Section 138 of Negotiable Instrument Act and sentenced to pay a fine amount of Rs.4,45,000/- and in default, the accused to undergo simple imprisonment for a period of 6 months. 3. Today the parties, after detailed negotiation along with their respective counsel, settled the dispute before this Lok Adalat and filed a joint memo, which reads as under;
1. The parties to the above case have amicably settled their dispute in Lok Adalat on 11.09.2025 of Rs.1,40,000/-(One Lakh Forty Thousand only) before on 10.10.2025 without fail.
The case is reopen in Hon’ble Court if the petitioner fail to make the payment as agree on or before 10.10.2025, this at liberty to proceed in accordance with the law. 2. In view of the above settlement, the parties humbly pray that this Hon’ble Court may be pleased to dispose of the above case in terms of this joint memo in the interest of justice and equity. 4. It is submitted by the learned counsel for the petitioner that in view of the interim order passed by this Court, the revision petitioner has deposited a sum of Rs.2,00,000/- before the Trial
4 Court at Mysuru and the petitioner is ready to pay Rs.1,40,000/- on or before 10.10.2025. 5. It is submitted that the amount deposited before the Trial Court at Mysuru has already been withdrawn by the respondent/complainant. It is further agreed that in case the revision petitioner fails to pay the agreed amount of Rs.1,40,000/- by way of RTGS, DD, cash on or before 10.10.2025, then the respondent is at liberty to proceed in accordance with the law.
