HC-KAR NC: 2025:KHC:38885 WP No. 24659 of 2025
CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER
Learned Additional Government Advocate takes notice for all the respondents.
2. The grievance of the petitioners is that despite there being a Mutation Order in M.R.No.8/1993-94, as could be seen at Annexure-E, that the names of Sri. Rajendra and Smt.Honnamma, being directed to be entered in the revenue records in respect of 9 acres 8 guntas in Survey No.71/3 of Kareem Sonnenahalli Village, Madhure Hobli, Doddaballapur Taluk, Bengaluru Rural District, the names of said persons are not entered in the revenue records. The petitioners herein are the legal heirs of the said Sri.Rajendra and Smt.Honnamma. In this regard, several representations have been given to the Tahsildar, Doddaballapur Taluk, to firstly enter the names of Sri Rajendra and Smt.Honnamma in terms of M.R.No.8/1993-94 and thereafter consider the applications of the petitioners to be entered on the ground of succession, the Tahsildar has not passed any order.

3. In the considered opinion of this Court, the fourth respondent/Tahsildar is duty bound to consider the applications and pass necessary orders after verifying the records as to whether the contentions of the petitioners herein are correct. If the fact as narrated herein above are correct, and there is a mutation entry in M.R.No.8/1993-94, then the Tahsildar shall proceed to firstly enter the names of Sri.Rajendra and Smt.Honnamma in terms of the Mutation Order. Thereafter, the Tahsildar shall consider the applications filed by the petitioners for entering their names on the ground of Succession. For that purpose, notices shall be issued to all concerned, verify as to whether the petitioners herein are the only legal heirs of Sri.Rajendra and Smt.Honnamma, thereafter proceed to pass
order, in accordance with law. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of three months from the date of receipt of a copy of this order. Ordered accordingly.
