He was transferred from Government Inter College, Mehuwala, Dehradun to Government Inter College, Kaljikhal, Deval, District Pauri Garhwal, vide order dated 26.06.2023. Challenging the transfer order, petitioner filed this writ petition. 4. Coordinate Bench has passed an interim order, pursuant to which petitioner is still serving at the original place. 5. Learned counsel for the petitioner submits that the State Medical Board has certified that petitioner’s son is suffering from Schizophrenia, therefore, petitioner is entitled to the benefit of Section 3 (d) of the Transfer Act. 6. Learned State Counsel submits that petitioner’s transfer was necessitated because of the fact that he had served in sugam places for more than seventeen years and the services rendered by him in durgam places is only about ten months. He further submits that petitioner may make a representation 2025:UHC:8963 highlighting the aforesaid aspect and the competent authority shall look into the matter. 7. Accordingly the writ petition is disposed of by permitting the petitioner to make representation to the competent authority. It shall be open to him to enclose the certificate issued by the State Medical Board along with his representation. If he makes representation within one week from today, the competent authority shall take decision thereupon within four weeks thereafter. 8. For a period of six weeks or till decision is taken on petitioner’s representation, whichever is earlier, status quo as regards his posting shall be maintained.
