For Petitioners : Ms.K.Porkodi Counsel for the Government of Tamil Nadu For Respondents : Mr.S.Chellapandian for R1 C O M M O N O R D E R These writ miscellaneous petitions have been filed seeking vacation of the interim orders dated 22.09.2025, 25.09.2025, 09.10.2025 and 13.11.2025 passed by this Court in the above respective writ petitions. 2. As a matter of fact, counter-affidavits / affidavits filed in support of the present writ miscellaneous petitions are one and the same. 3. The writ miscellaneous petitions seeking vacation of the interim orders dated 22.09.2025, 09.10.2025 and 13.11.2025 and the counter- affidavits filed in support of writ miscellaneous petitions seeking vacation of the orders dated 09.10.2025 & 13.11.2025 are one and the same. By the date _______________ https://www.mhc.tn.gov.in/judis W.M.P.(MD) No.24636 of 2025 etc. batch of passing of the order 13.11.2025, counter-affidavits were already on record and the same were considered by the Coordinate Bench of this Court and then only, the said order dated 13.11.2025 has been passed. However, while passing the said order, no reference was made to the petitions seeking vacation of the interim orders filed by then. On the very same grounds, the orders dated 09.10.2025 & 13.11.2025 are sought to be vacated, once again by filing fresh vacate petitions. 4. Admittedly, the impugned proceedings in all these writ petitions dated 21.08.2025 have been issued cancelling the approval of the appointment of the respective writ petitioners in the post of P.G.Assistant in the respondent – School, on the ground that a complaint has been received against them complaining about forgery of certain documents in connection with the constitution of the Managing Committee of the respondent – School. But, admittedly, no opportunity has been afforded either to the writ petitioners or to the Management of the respondent – School before issuing the impugned proceedings. In view of the same, the proceedings impugned in the main writ petitions cannot stand for want of compliance of the principles of natural justice, as the same would adversely affect the livelihood of the writ petitioners. _______________ https://www.mhc.tn.gov.in/judis W.M.P.(MD) No.24636 of 2025 etc. batch 5. This Court, while passing the orders dated 09.10.2025 & 13.11.2025, has taken into consideration all these aspects and came to the conclusion that the final disposal of these writ petitions has to await filing of final report in the criminal case in Crime No.275 of 2025, on the file of Dhalavaipuram Police Station, Virudhunagar District. 6. This Court, at this stage, does not see any reason to take a different view, especially, in the context of the facts that there is no dispute about the writ petitioners being fully qualified for holding the post of P.G.Assistant in the respondent – School and they have been continuously working as P.G.Assistants in the respondent – School since their date of appointment and therefore, they cannot be denied salary for the period during which they worked. 7. In the circumstances, this Court does not see any reason to vacate the interim stay / orders passed by this Court in the above writ petitions. Accordingly, the interim orders / stay granted by this Court in the above writ petitions are hereby made absolute.
