Sharma, learned counsel for the writ petitioners. Also heard Ms. A. Talukdar, learned Government Advocate, Assam and Mr. S. Dutta, learned Standing Counsel, Revenue and DM Department, Assam, appearing for the official respondents. The petitioners herein had submitted their candidature in response to the advertisement notice dated 17/03/2023 issued by the District Commissioner, Morigaon, for filling up 8 vacancies of Mondol. However, the recruitment process was kept on hold. Aggrieved thereby, the petitioners had approached this Court by filing the instant writ petition seeking a Writ of Mandamus directing the authorities to proceed with the recruitment process. When the matter was pending before this Court, the District Commissioner, Morigaon, issued notification dated 28/01/2025, cancelling the advertisement dated 17/03/2023. A copy of the Page No.# 3/3 notification dated 28/01/2025 has been produced by Mr. S. Dutta, learned Standing Counsel, Revenue & DM Department, Assam, for perusal by the Court. Ms. A. Talukdar, learned Government Advocate, Assam, appearing on behalf of the State submits that since the advertisement dated 17/03/2023 has itself been cancelled, nothing further survives for adjudication in this writ petition. The petitioners’ counsel has also accepted the said position. In view of the above, this writ petition stands disposed of by granting liberty to the petitioners to assail the notification dated 28/01/2025, in accordance with law, if so advised.
