Applicant Faeem Alia Atm who is a charge sheeted accused and facing trial before Court below has approached this Court by means of present applicaiton under section 482 Cr.P.C. for a direction to Court below to decide Sessions Trial No. 793 of 2021 (State Vs. Faeem Alia Atm and Others) arising out of Case Crime No. 33 of 2014, under sections 302 and 201 IPC, Police Statoin- Bilari, District- Moradabad with all expedition and preferably within a time period fixed by this Court. At the very outset, the learned counsel for applicant fairly submits that applicant be permitted to withdraw the present application with liberty to file fresh, as there are inherent mistakes in present application which cannot be cured even by filing a supplementary affidavit or an amendment application. He, therefore, submits that present application be dismissed as withdrawn with liberty to file fresh with better particulars, details and proper relief. Prayer made by the learned counsel for applicant is bonfafide. Same is not opposed the by the learned A.G.A. Accordingly, it is allowed. In view of above, present application is accordingly dismissed as withdrawn with liberty aforesaid. Certified copies of the documents appended along with this application shall be returned to the learned counsel for applicant after obtaining photo copies of the same to be kept on record.
