A memo dated 15.10.2025 has been filed, signed by the learned counsel for the petitioner, which reads as under; - 3 - HC-KAR NC: 2025:KHC:44236 CMP No. 278 of 2025 MEMO FOR WITHDRAWAL The counsel of Petitioner most humbly submits that the present petition is filed to appoint arbitrator as per Clause 12.1 of Enterprise Solution Resale Agreement dated 27.01.2024 (hereinafter referred to as "ESRA"). It is submitted that the parties herein have settled the disputes arising out of the ESRA vide settlement agreement and general release dated 26.09.2025 (hereinafter referred to as settlement agreement). The settlement agreement entered between Petitioner and Respondent No.1 is produced herewith and marked as Document No.1. Hence, the counsel of Petitioner craves leave of this Hon'ble Court to take this memo and settlement agreement dated 26.09.2025 on record and withdraw the present civil miscellaneous petition, in the interest of justice and equity. 3.
