Petitioner is a tenure holder whose holding is situate in Village Bhagwantpur, Tehsil Kashipur, District Udham Singh Nagar. By means of this writ petition, petitioner has sought the following relief:- “i) Issue a writ order or direction in the nature of mandamus commanding and directing respondent no. 3 and 4 to conduct demarcation of the land in question as per revenue record submitted by the petitioner along with application dated 23.04.2019 i.e. Annexure No. 4 along with map of Village Bhagwantpur, Tehsil Kashipur District Udham Singh Nagar.” 4. Learned State Counsel was granted time to get instructions in the matter. Today, on instructions, Mr. Nailwal, learned State Counsel submits that holding of petitioner was measured and 2025:UHC:6701 after measurement, the land of petitioner comprised in Khasra No. 31 was found to be less by 0.152 hectare. It was further found that petitioner’s holding is situate on the meeting point of two villages, therefore, without correcting the map, petitioner’s land cannot be demarcated. He thus submits that the proper remedy for petitioner is to move an application for correction of map under Section 28 of Land Revenue Act. The written instructions, produced by learned State Counsel, are taken on record, which shall also be paginated. 5. The writ petition is, accordingly, disposed of with liberty to petitioner to move application for correction of map before the appropriate forum.
