Shah for the petitioner Ali Hussain, who has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with PRC Case No. 292/2024 arising out of Lakhipur Police Station Case No. Page No.# 2/2 07/2024 under Sections 142/120(B)/447/325/325 of the IPC. 2. Heard Mr. K. K. Das, learned Additional Public Prosecutor for the respondent State. 3. It is submitted that charge-sheet has been laid against the petitioner. The petitioner is willing to cooperate with the trial. It is also submitted that the victims have sustained simple injuries and they are not complicit. 4. Learned Additional Public Prosecutor has raised objection against the petitioner’s prayer for pre-arrest bail as the petitioner has not cooperated with the investigation. The petitioner is shown as an absconder in the charge-sheet. 5. I have considered the submissions at the Bar with circumspection. 6. This case is triable by the First Class Magistrate. The petitioner is willing to cooperate with the trial. 7. The petitioner is hereby directed to appear before the learned Trial Court/Jurisdictional Court and apply for bail which may be considered by the Court in accordance with law.
