Singh, learned A.G.A.-1 appearing for the State respondents. 2. This writ petition has been filed praying to quash the impugned First Information Report dated 02-07-2024 registered as Case Crime No. 226 of 2024, under Sections 498A, 376D, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Fatehganj West, District Bareilly. 3. Vide order dated 21-08-2024, the matter was referred to the mediation centre. 4. Perused the office report dated 17-03-2025, which indicates that matter has been peacefully settled between the parties and they have settled their differences on the terms mentioned in paragraph 7 of the settlement agreement dated 24-11-2024. The paragraph 7 is quoted as under:- “7. ववादकवाररिययों कके बबीच मम ननिम्निललिलखित समझझौतवा सम्पन्न हहआ हहह- क. यह नक ददोनिदो पक्ष नपछलिके पवापाँच महबीनियों सके सझौहवादर एएंव पपूरर स्निकेह पपूवरक बतझौरि पतबी पत्निबी कके रूप मम रिह रिहके हह एएंव आज मध्यस्थ कके समक्ष उपसस्थत हह औरि कथनि करितके हह नक आगके भबी वके ददोनियों पपूरर सझौहवादर औरि स्निकेह पपूवरक सवाथ-सवाथ रिहमगम तथवा वहववानहक जबीवनि कके दवानयत्वयों कवा ननिववारहनि करिमगके तथवा एक दपूसरिके कवा सम्मवानि करिमगके। खि. यह नक ददोनिदो पक्षयों निके एक निदोटरिबी ससुलिहनिवामवा भबी तहयवारि नकयवा हह एवएं ददोनिदो पक्षयों निके इस दस्तवावकेज परि अपनिके हस्तवाक्षरि करि नदए हह। उपरिदोक्त ससुलिहनिवामवा ककी प्रमवानरत प्रनत ददोनिदो पक्ष मवानिनिबीय न्यवायवालिय कके समक्ष प्रस्तसुत करिकेगम । ग. यह नक पनत आश्वस्त करितवा हह नक वह अपनिबी पत्निबी एवएं पसुतबी कवा पपूरिवा ध्यवानि रिखिमगवा एवएं उसककी सभबी जरूरितयों औरि आवश्यकतवाओएं कदो पपूरर करिमगवा। घ. यह नक ददोनिदो पक्षकवारियों कके सगके-सएंबएंधबी ददोनिदो कके शवासन्तपपूरर वहववानहक जबीवनि मम हस्तक्षकेप निहहीं करिमगम। ङ. यह नक ददोनिदो पक्ष एक दपूसरिके कके नवरुद्ध पएंजबीकक त/नवचवारिवाधबीनि समस्त ववाददो कदो ववापस लिमगके। च. यह नक ददोनिदो पक्ष एक दपूसरिके कके लखिलिवाफ , इस वहववानहक ववाद कके सएंन्दभर मम कदोई नियवा ववाद दवायरि निहबी करिमगके।" 5. It is submitted that as between the parties compromise had already taken place therefore, the impugned First Information Report dated 02-07-2024 registered as Case Crime No. 226 of 2024, under Sections 498A, 376D, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Fatehganj West, District Bareilly is liable to be quashed. 6. Thus, in view of the well settled principles of law as laid down by the Hon'ble Apex Court reported in 2003(4) SCC 675 (B.S. Joshi Vs. State of Haryana), J.T. 2008(9) SC 192 (Nikhil Merchant Vs. Central Bureau of investigation and another), (2012) 10 SCC 303 (Gian Singh Vs. State of Punjab), (2014) 9 SCC 653 (Yogendra Yadav and others Vs. State of Jharkhand) and also (2014) 6 SCC 466 (Narendra Singh Vs. State of Punjab) and in view of the settlement agreement dated 24-11-2024, the impugned First Information Report dated 02-07- 2024 registered as Case Crime No. 226 of 2024, under Sections 498A, 376D, 323, 504, 506 IPC and 3/4 D.P.
