The present appeal is filed against the judgement and order dated 11.03.2005 passed by learned Additional District and Sessions Judge, Court No. 2, District Mau, in Session Trial No. 207 of 2002. 2. Perused the office report dated 01.03.2025 based on the report of Chief Judicial Magistrate, Mau, dated 05.02.2025. According to which, the sole appellant Jawahir Yadav died several years back and his residence is locked and no one is available. The statement of Sub Inspector Akhtar Ali and the statement of village pradhan Geeta Yadav were entrusted with the enquiry. The statement of Geeta Yadav, the Village Pradhan, has been recorded in the report of Chief Judicial Magistrate. 3. On perusal of the statement recorded under Section 313 Cr.P.C. in the year 2004 we find that at that time he was aged about 50 years. 4. Accordingly, the appeal in respect of the sole appellant-Jawahir Yadav stands abated. 5.
