Neutral Citation No. - 2025:AHC:145974 Court No. - 4 Case :- WRIT - C No. - 28426 of 2025 Petitioner :- Shri Sachet Prakash Respondent :- The Chief Controlling Revenue Authority And 2 Others Counsel for Petitioner :- Ramendra Asthana Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard Sri Ramendra Asthana, learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has assailed the order passed by the revisional authority, namely, Chief Controlling Revenue Officer, Prayagraj on 04.08.2025 by which petitioner's interim stay application has come to be rejected. 3. Learned Standing Counsel for the State submits that although there is no statutory requirement to deposit as such but the petitioner has avoided the liability of deposit under the Stamp Act by prerfering directly a revision instead of an appeal and therefore, in equity the revisional authority is justified in directing the petitioner to deposit one-third amount of stamp liability. 4. Having heard learned counsel for the respective parties and having perused the record, in my considered view the ends of justice would get served in the event revision-petition pending before the Revenue Authority, Board of Revenue is directed to dispose of the pending revision bearing no.3229 of 2025 itself on merits. 5. In view of the above, this petition stands disposed of with direction to the authority concerned to dispose of the pending revision of the revision-petitioner within thirty days of production of certified copy of this order provided petitioner does not seek any adjournment.
