2025:JHHC:18086 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.2000 of 2025 ------ Pinku Rajbanshi, S/o Satish Rajbanshi, resident of village Pirpainti Bazar, Manikpur, PO and PS Pirpainti, District Bhagalpur, Bihar … … Petitioner(s) Versus The State of Jharkhand. … … Opposite Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Md. Yasir Arafat, Advocate. Mr. Ranjan Kr. Ravidas, Advocate For the State : Mr. Shailesh Kumar Sinha, A.P.P. ----- 03/ 07.07.2025 Heard the parties. 2. This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 379 of Indian Penal Code pending in the court of learned SDJM, Sahibganj in connection with Mirzachouki PS Case No. 43 of 2024. 3. The allegation against this petitioner is that the motorcycle of the informant which was stolen was recovered from the possession of the petitioner. 4. During course of investigation the name of the petitioner transpired as one of the accused person. 5. Learned counsel for petitioner submits that the petitioner is not aware that the motorcycle was stolen and admits that he has purchased the motorcycle without having knowledge that the same was stolen. 6. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 2025:JHHC:18086 2 7. After hearing the parties, I find that the petitioner has another case of similar nature against him which is Jirwabari PS Case No. 80 of 2024. Further the stolen motorcycle was recovered from the possession of this petitioner, thus, this Court finds it not a fit case for grant of anticipatory bail to the petitioner. 8. Accordingly, this Anticipatory Bail Application stands dismissed. (ANANDA SEN, J.) Tanuj/Cp-3
