Heard learned counsel Mr.R.A.Ahmed for the petitioner Haridas Mandal who has filed this application under Section 483 of the BNSS, 2023 praying for bail as he is behind the bars since 20.02.2025 in connection with Dharamtul P.S. Case No. 12/2025 under Sections 108/69 of the BNS, 2023. Page No.# 2/3 2. Learned Addl.Public Prosecutor Mr. D.P.Goswami is present for the respondent State. 3. Case Diary is received. 4. The allegation against the petitioner is that he eloped with the informant’s daughter and stayed with her in Rajasthan as husband and wife. Thereafter, the accused No.2 who is the father of petitioner brought back the petitioner and informant’s daughter to their house. The informant’s daughter was subjected to cruelty and after 15 days, the accused No.2 named in the FIR took the informant’s daughter to her parental home on assurance that he will again take her back but he did not take her back. When he refused to take her back, the victim committed suicide on 13.02.2025. 5. I have considered the submissions at the Bar with circumspection. 6. It is submitted by the learned Addl.Public Prosecutor that there are materials in the Case Diary that the allegation in the FIR has been substantiated by the witnesses. It is also submitted on behalf of the petitioner that the petitioner was not involved in instigating or abetting the victim to commit suicide. 7. I have also scrutinized the case diary. 8. Investigation has progressed substantially. It appears that bail may be granted to the petitioner. Petitioner is willing to abide by any conditions, if imposed upon him 9. Considering all the aspects, prayer for bail is hereby allowed. Page No.# 3/3 10. The petitioner named above shall be enlarged on furnishing bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Morigaon under the condition that:- (i) That the petitioner shall co-operate with the remaining part of the investigation. 11.
