3. GP FOR ENDOWMENTS The Court made the following ORDER:
The Writ Petition is filed seeking to declare the action of the 1st respondent in not considering representation dated 27.12.2000 and 27.09.2002 of the petitioner seeking correction of anomaly in salary occurred due to the proceedings of the 2nd respondent vide proceedings dated 11.12.1999 as illegal, arbitrary, etc., and for consequential direction.

2. Heard learned counsel for the petitioner and Ms. A. Vasavi, learned counsel representing the learned Government Pleader for Endowments.
3. The grievance of the petitioner appears to be with regard to non-
consideration of the representations dated 27.12.2000 and 27.09.2002 made by the petitioner for rectifying the anomaly crept in the pay scale.
4. At the time of considering the matter, Ms. A. Vasavi, learned counsel representing the learned Government Pleader for Endowments placed a copy of the proceedings dated 24.04.2011 addressed by the 2nd respondent to the 1st respondent, wherein, it is mentioned as follows:-
“Whereas, Sri R. Ranganatha Charyulu, Tallha Swamy who was given time scale of Record Assistant along with the applicant is also working as Taliha Swamy and though he was sanctioned Revised pay Scales of 2005 carrying the time scale of Rs. 4825-10845 i.e, archaka scale in terms of the rules framed in G.O.Ms.No.261, Revenue (Endowment-I) Department, dated 20-05-2002, he was also sanctioned special Grade Scale in lieu of completion of 8 years of scale and drawing basic pay of Rs. 8385/-as on 01- 04-2009 in the time scale of Rs. 5200-11755. Thus, the applicant i.e, Sri T. Ranga Charyulu, archaka is drawing basic pay of Rs.7,015/- as on 01-06-2010 and whereas, Sri R. Ranganatha Charyulu, Taliha Swary is drawing basic pay of Rs. 8,600/-as on 01-04-2010 though who is junior than the applicant. Hence the applicant is also entitled to have pay protection on par with his junior as per Service Rules.

I also submit that the applicant has also filed a writ petition before the Hon'ble High Court, A.P., Hyderabad in W.P. No. 22900/2002 with prayer to direct the respondents to pay salaries duly giving benefits accrued by rectifying the anamalies in his pay fixations. In the said writ petition, the Commissioner, Endowments Department, A.P., Hyderabad and that the Assistant Commissioner and Executive Officer of the subject temple are Respondent Nos.1 and 2 respectively. Counter-affidavits have also been filed on behalf of the 2nd - respondent and that the writ petition is pending. However, a copy of counter-affidavit is herewith submitted which may also kindly be treated as part and parcel of my remarks. I therefore request that the Commissioner, Endowments Department, A.P., Hyderabad may be pleased to consider the above facts and necessary orders may kindly got be communicated at an early date.”
5. In view of the above stated position, in order to put a quietus to the matter, the 1st respondent is hereby directed to take necessary action on the petitioner’s representations dated 27.12.2000 and 27.09.2002 by taking into
consideration the communication dated 24.04.2011, in accordance with Law, after giving due opportunity to the petitioner, within a period of six (6) weeks, from the date of receipt of a copy of this Order.
Accordingly, the writ petition is disposed of. There shall be no order as to costs. As a sequel, all pending applications shall stand closed.
