ORDER This Civil Revision Petition has been filed challenging the impugned
order dated 10.01.2025 passed by the II Additional Sub Court, Coimbatore in I.A.No.5 of 2024 in I.A.No.4 of 2022 in O.S.No.213 of 2014. 2. In the aforesaid order, the application filed by the petitioner who is the 1st defendant in the suit, seeking to set aside the exparte decree dated 30.06.2022 passed in O.S.No.213 of 2014, on the file of II Additional Sub Court,Coimbatore was allowed, on condition that the petitioner/1st defendant deposits a sum of Rs.2,00,000/- (Rupees Two Lakhs) to the credit of the suit, on or before 14.06.2024. Aggrieved by the condition imposed by the Trial Court for allowing the application seeking to set aside the expart decree, the petitioner/ 1st defendant has filed this Civil Revision Petition. 3. At the outset, learned counsel for the petitioner, on instructions would submit that the petitioner is now willing to pay directly to the https://www.mhc.tn.gov.in/judis
CRP No. 2114 of 2025 __________ Page3 of 5 respondents/plaintiffs a sum of Rs.2,00,000/- (Rupees Two Lakhs only) provided, the exparte decree passed by the Trial Court is set aside by this Court. 4. Learned counsel for the respondents/plaintiffs has also stated that he has no objection for the submission made by the learned counsel for the petitioner, provided a direction is issued to the Trial Court, to dispose of the suit within a time frame to be fixed by this Court. He would also submit that written statement has not been paid by the petitioner/1st defendant in the suit. 5. Learned counsel for the petitioner/1st defendant would submit that along with the application seeking to set aside the exparte decree, the written statement has been filed. 6. After hearing the submission of both the counsels, this Civil Revision Petition is disposed of, by setting aside the impugned order dated 10.01.2025 passed by the II Additional Sub Court, Coimbatore in I.A.No.5 of 2024 in I.A.No.4 of 2022 in O.S.No.213 of 2014, on condition that the petitioner pays a sum of Rs.2,00,000/- (Rupees Two Lakhs only), directly to the respondents/plaintiffs within a period of one week from the date of receipt of a copy of this order and failure to pay the said amount within the stipulated time, this Civil Revision Petition shall stand dismissed automatically.

The Trial Court is directed to dispose of the suit in O.S.No.213 of 2014 on the file of II Additional Sub Court, Coimbatore, within a period of one year from the date of receipt of a copy of this order.
