Hon'ble Dinesh Pathak,J. 1. The present application has been filed beseeching the expeditious disposal of Session Trial No. 300 of 2024 (State Vs. Gaurav Agarwal and others), arising out of Case Crime No. 362 of 2006 under Sections 272, 273, 420, 486 I.P.C., Police Station - Hapur Nagar, District-Hapur, pending before the Court of Chief Judicial Magistrate, Hapur. 2. Record evince that opposite party no.2 has lodged an FIR dated 15.5.2006. After due investigation, the Investigating Officer has submitted the charge sheet on 26.6.2006. By order dated 5.4.2024, the case was committed to the sessions court and the charges were framed on 27.9.2024. The present applicant, namely, Gaurav Agarwal, has already appeared before the court below. Since then, the matter is protracted owing to non-cooperation of the prosecution. The pendency of the proceedings will encompass prejudice and oppression to the present applicant. 3. Learned AGA has no objection in case a direction is issued for early disposal of the aforesaid case. 4. In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present application, without making any observation on the merits of the case as mentioned in the present application, with a direction that the court concerned, before whom the aforementioned case is pending consideration, shall decide the same expeditiously, as early as possible. 5. It is expected that the matter should be decided by a reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments to either of the parties. 6. With the aforesaid direction, present application is disposed of.
