W.P.No.31628 of 2025 O R D E R This Writ Petition has been filed to direct the first to third respondents to permit the Team consisting of S.Yadeswar, M.Mohit Raj, R.Lakshit and Arwaz Khan of Velammal International School, Panchatti, Tamil Nadu to participate in 4 * 100 metres relay (under-14 Boys) in the CBSE Athletics National Competition 2025 being held by the sixth respondent from 10.09.2025 to 13.09.2025 at Varanasi or any other remedy. 2. The petitioner's son and his teammates participated in the CBSE Cluster VI Athletics Championship 2025 - 2026 held in July 2025 at the fourth respondent School. However, their team was disqualified in the selection and was asked to submit birth certificates for validating the date of birth, even though the team has submitted Aadhar Cards as a proof of date of birth.
The petitioner further states that the disqualification of the petitioner son's team has lowered their morale and denied the rightful recognition, hence the petitioner seeks for a writ of mandamus directing the respondents 1 to 3 to permit the petitioner's son and his teammates to participate in 4 * 100 meters at Varanasi. _________ https://www.mhc.tn.gov.in/judis

3. It is the submission of the learned counsel for the respondent Nos.1 and 2 that though the petitioner has claimed that the petitioner's son's team have fair enough in the qualification round held in the fourth respondent School, they have denied the opportunity of participating in the finals to be held at Varanasi and they have not challenged the disqualification order / communication issued in that regard. But they have only filed the present writ petition seeking a mandamus directing the respondents permit them to participate in the finals and hence, the writ petition is not maintainable. 4. Heard the learned counsel appearing for the petitioner, learned counsel for the respondents 1 & 2 and the learned counsel appearing for the respondent No.5. The respondents 3 & 4 though were served, were not represented by a counsel. 5. Admittedly, the petitioner is seeking a direction to participate in the event to be held in 2nd Week of September, 2025, without even attaching _________ https://www.mhc.tn.gov.in/judis
W.P.No.31628 of 2025 the disqualification communication. In fact, the said disqualification has not been challenged before this Court. Unless the said disqualification is challenged by raising valid grounds and producing ample evidences to substantiate their stand that the petitioner's son's team are fully qualified to be selected to participate in the finals, they cannot seek for an innocuous prayer just to participate in the finals, which ultimately is based on the selection in the qualification rounds. Therefore, this Court finds no merit in the Writ Petition and accordingly, the same is dismissed. However, there shoal be no order as to costs. Connected miscellaneous petition is closed.
