She was transferred vide order dated 26.06.2023 from Government Inter College Mahuwadabra, District Udham Singh Nagar to Government Higher Secondary School Gauniyaro, District Nainital. 4. Challenging the transfer order, petitioner filed this writ petition. The contention of the petitioner is that since he was posted in a Government Model School, therefore, he cannot now be re- transferred to other schools. 5. Learned State Counsel, however, submits that the Transfer Act is applicable to all teachers and no exception is made in favour of the teachers serving in Model Schools. He further submits that there is one unified cadre of Assistant Teachers, L.T. Grade 2025:UHC:8953 and petitioner also belongs to the same cadre. He further submits that at the time of his transfer, petitioner had put in nearly seventeen years service in durgam place, therefore, as per Transfer Act, he was liable to be transferred to a durgam place. 6. Since the petition was filed in the year 2023 and petitioner is still continuing at the original place where he was serving earlier, pursuant to the interim order, no useful purpose would be served by keeping this writ petition pending. 7. Accordingly, the writ petition is disposed of with liberty to the petitioner to make representation to the Additional Director, School Education, Kumaon Region. If he makes representation regarding his transfer within two weeks from today, the concerned Additional Director shall take decision thereupon within six weeks thereafter. 8. For a period of eight weeks, status quo as regards petitioner’s posting shall be maintained.
