Heard Sri Shiv Banadur Yadav, learned counsel for the petitioners, Sri Abhishek Shukla, learrned Additional Chief Standing Counsel appearing for the State-respondents and Sri Rajan Chauhan, holding brief of Sri Azad Rai, learned counsel for the Gram Sabha- respondent no.3. The present petition has been filed, seeking a direction to respondent No.2/Sub-Divisional Magistrate, Tehsil Phoolpur, District Prayagraj to decide Case No.71 of 2023 (Shivram and others vs. Gaon Sabha and others) under Section 24 of the U.P. Revenue Code 2006, expeditiously and within a stipulated period.
Learned counsel for the petitioners has referred to the order sheet of the case, a copy whereof has been appended to the writ petition, to point out that although several dates have been fixed but for some reason or the other, the matter has been adjourned and the delay in disposal of the case is causing undue hardship to the petitioners. Accordingly, a prayer is made for a direction to the court/authority concerned to conclude the proceedings expeditiously and at an early date.
Learned counsel for the State-Respondents has no objection to the prayer made. Having regard to the aforesaid, the present petition is disposed of with an observation that the court/authority concerned would make an endeavor to conclude the proceedings of the case, which is stated to be pending before it, preferably within a period of six months, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
