ORAL ORDER
Petitioner is seeking to direct the trial Court for a time-bound disposal of C.C.No.34439/2022 pending before the learned XXXIX Additional Chief Judicial Magistrate, Bengaluru.
2. Charge sheet is filed against the petitioner for the offence punishable under Section 454 and 380 of IPC. It is the case of prosecution that in between 29.11.2021 and 01.12.2021, accused has committed theft of gold and silver ornaments and cash of Rs.50,000/- in all worth

Rs.6,00,000/- from the complainant’s house situated at #337, 7th Sector, 9th Main road, HSR Layout.
3. It is the contention of the learned counsel that the petitioner is in judicial custody in another case and in the present case, charge sheet has been filed, however, there is no progress in trial.
4. HCGP has contended that there are many cases registered against the petitioner and in all the cases, charge sheets are filed and he is facing trial in those cases. He submits that charges are not framed in the present case and body warrant has been issued against the petitioner.
5. In the above facts and circumstances, direction cannot be issued to the trial Court for a time bound disposal of the case. Such directions will adversely effect the functioning of the trial Court and may be difficult to implement. However, considering that the charges sheet is already filed, learned Magistrate is directed to expedite

the trial. With the said observation, petition is
disposed of.
