Neutral Citation No. - 2025:AHC:21606 Court No. - 5 Case :- WRIT - A No. - 1202 of 2025 Petitioner :- Suraj And 4 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Love Lesh Kumar Verma Counsel for Respondent :- C.S.C. Hon'ble Ajay Bhanot,J. Shri Lavelesh Kumar Verma, learned counsel for the petitioner contends that the petitioner is entitled to the benefit of the old pension scheme. A representation has been made by the petitioner in this regard but to no avail. The only prayer made by the learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Learned Standing Counsel contends that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, he fairly contends that the service benefits/claims are liable to be decided by the competent authority in a reasonable time frame. In the wake of the submissions and without going into the merits the respondent no. 2 is directed to decide the representation of the petitioner regarding computation of his length of service for grant of old pension scheme within a period of three months from the date of receipt of certified copy of this order along with a fresh copy of representation. The writ petition is disposed of. Order Date :- 14.2.2025 Dhananjai Digitally signed by :- DHANANJAI High Court of Judicature at Allahabad
