3. Petitioner is serving as Assistant Teacher, L.T. Grade (English). She was transferred from Government Inter College, Kotdwara, Pauri Garhwal to Government Inter College, Gwalkhuda, Block Pabo, District Pauri Garhwal, vide
order dated
26.06.2023. Feeling aggrieved by her transfer, she filed this writ petition.
4. Coordinate Bench passed an interim
order in favour of the petitioner on 09.08.2023, pursuant to which, petitioner is still serving at the original place of her posting.

Learned State Counsel submits that at the time of her transfer, petitioner had served at sugam places for more than fourteen years and presently she has completed sixteen years of service in sugam places, therefore, as per provisions of the Transfer Act, she had become due for transfer to a durgam place; accordingly, the transfer order was passed in her favour. He further submits that respondent no. 6 had put in continuous
2025:UHC:8867 satisfactory service in durgam places for more than twenty three years, therefore, he was entitled to be transferred to a sugam place, therefore, in place of the petitioner, respondent no. 6 was transferred to Kotdwara, however, on account of interim
order passed by Coordinate Bench, respondent no. 6 is still continuing in the institution where she was serving all along.

Learned counsel for the petitioner submits that petitioner is a widow and as per Government Policy, while transferring widows, option has to be invited, which was not done in the case of the petitioner.
7. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to the competent authority against her transfer. In the representation, she may also indicate three institutions, where she wishes to be transferred. If she makes such representation within ten days from today, decision thereupon shall be taken within four weeks thereafter.
8. For a period of six weeks or till decision is taken, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
